Daniele Portinaro is an expert in corporate restructuring and provides legal assistance to businesses in financial distress. He advises on the preparation of applications for debt restructuring procedures including: composition with creditors under Article 84 of the Italian Code of Business Crisis and Insolvency (CCII), certified recovery plans under Article 56 CCII, debt restructuring agreements pursuant to Article 57 CCII and subsequent provisions, moratorium agreements under Article 62 CCII, tax settlements under Article 63 CCII, and composition plans in judicial liquidation under Article 240 CCII and following articles. He also supports entrepreneurs in the negotiated settlement of the business crisis and assists debtors in over-indebtedness resolution procedures.
Professional Experience
In 2014, he partnered with Elisa Castagnoli to found the associated law firm Portinaro-Castagnoli.
In 2015, he became a founding partner of Elexia Avvocati & Commercialisti.
Appointments
For nearly thirty years, he has served as Bankruptcy Trustee and Judicial Commissioner at the Court of Milan. Since 2016, he has also acted as a crisis manager at the Crisis Settlement Body of the Milan Bar Association and at the Arbitration Chamber of Milan. Since March 2022, he has been listed among the experts authorized to assist with negotiated business crisis settlements, and as of March 2023, he is registered in the National Register of Business Crisis Managers.
Publications
He is a frequent speaker at conferences on corporate crisis and contributes articles to leading journals focused on debt restructuring. He is also the editor and co-author of the monograph “La liquidazione giudiziale dell’imprenditore insolvente” (The Judicial Liquidation of the Insolvent Entrepreneur), published by Giuffrè in March 2023.
